Terms Of Service
This TVLabs Service Agreement (the "Agreement") describes the terms and conditions on which TVLabs ("we" or "our company") offer services to you ("Customer"). By registering for or using TVLabs services, Customer agrees to be bound by the following terms and conditions.
General conditions
TVLabs is a self-moderated file-sharing community and a file-proxy service. All files hosted on TVLabs were uploaded by Customers or fetched automatically as per Customer(s) request from publically available Internet sources. All texts (including but not limited to: descriptions, comments, reviews etc) are published and moderated by Customers.
Copyright
TVLabs Services may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation, including export control laws, is prohibited. This includes, without limitation, material protected by patent, copyright, trademark, service mark, trade secret or other intellectual property rights. If you use another party's material, you must obtain prior authorization. TVLabs reserves the right to suspend or terminate a Customer's transmission(s) that, in TVLabs's discretion, violates these policies or violates any law or regulation.
We cannot control actions of each Customer therefore the Customer is responsible for any illegitimate use of the TVLabs's Services.
Paid Services
TVLabs provides a platform for file-sharing and categorized storage of such files.
TVLabs does not sell any kind of content (or license(s) for its usage) hosted on its server nor we sell access to such content. Customers are charged for bandwidth only. The bandwidth fee is fixed (as per Customer's subscription plan) and does not depend on a type of content downloaded.
Downloading content from TVLabs or using it's paid services does not grant the right to use this content in any way.
Subscription billing period is 31 days. Customer's credit card is at the beginning of each billing period. Customer can cancel his subscription at any time (thus stopping the recurring billing) by contacting our support department. By the end of the billing period the remaining balance will not be rolled over to the next billing period.
Customer can manually recharge his card in order to upgrade/downgrade his subscription plan or increase the bandwidth quota. Such charge will start a new billing period and cancel all previous subscriptions automatically.
We reserve the right to modify the existing rates for the Services.
By paying for the Services the Customer fully accepts their cost of terms of their use.
Refunds
Customer can request a refund if he has added funds to his account by mistake and he hasn't used the TVLabs's Services yet (account balance is intact). Refund can be requested during 48 hours since his account was refilled. Refunds will be processed within 1-2 business days since time requested.
In all other cases payments are not refundable.
We will not issue a refund if downloaded content is not compatible with Customer's multimedia device or/and software.
The balance of cancelled account(s) is not refundable.
The use of any third-party software
Customer may need third-party software in order to use our Services. The Customer is fully responsible for using any software as well as for any expenses related to the use of the Site (internet traffic, software etc.)
We are not responsible for the quality of the Customer's internet connection therefore decline all responsibility for any financial losses or damage caused by the internet connection or provider problems.
Responsibility
We are not responsible for:
- any interruptions in the website operation,
- the quality or/and contents of the files hosted on our server,
- the further use of the downloaded files downloaded by the Customer,
- the quality of the Customer's internet connection therefore decline all responsibility for any financial losses or damage caused by the internet connection or provider problems,
- texts (including but not limited to: descriptions, comments, reviews etc) published on TVLabs.
Customer is responsible for:
- any unlawful or unauthorized use of any content downloaded from (or using) TVLabs,
- keeping his password and login information safe,
- for downloading any files from TVLabs,
- the legality of the content he published on TVLabs's server,
- correspondence of published materials with copyright law and other laws.
Other conditions
We reserve the right to change, amend, and supplement this Agreement on an occasional basis. In the event that you disagree with any clause of the amended Agreement, you should terminate your registration on TVLabs immediately and refrain from using it.
In case of authorized access by third parties to the Customer's account, the Customer is responsible for any actions made by the third parties using Customer's account.
